Junzhiquan Defends Huawei in High-Profile Patent Dispute over Product Manufacturing Methods

Junzhiquan Law Firm successfully represented Huawei in a patent dispute over a product manufacturing method, adjudicated by the Shanghai Intellectual Property Court on April 2, 2024. The case concluded with the plaintiff withdrawing their lawsuit, marking a decisive victory for our client.

In this case, the plaintiff asserted that the disputed patent covered a novel product manufacturing method and advocated for a reversal of the burden of proof. Addressing this, Junzhiquan undertook comprehensive research into the limited judicial precedents and guidelines relating to novel product manufacturing method patents in China, and developed a powerful, clear defensive strategy. We effectively articulated this strategy and presented compelling evidence to the Shanghai Intellectual Property Court, proving that the patent did not qualify as a novel product manufacturing method. Consequently, the traditional burden of proof was upheld, remaining with the plaintiff, who ultimately withdrew from the case.

Our legal team in this case was led by Lawyer LIU Jun, Lawyer LIN Ye, Patent Attorney LYU Zhanzhu, Lawyer HUANG Pinghui, Lawyer GUO Roushan, and Apprentice Lawyer BI Xun, each bringing their specialized expertise to forge a strong defense.
