Patent Consultation and Application

I. Junzhiquan's Approach to Patent Identification and Strategic Filing

1. We initiate the process by compiling a detailed inventory of potential patentable inventions for client approval.

2. Following client approval, we proceed the drafting and submission of domestic applications, or proceed with the international registration.

3. We then consult with clients about pursuing international protection through the PCT route or by direct filings in target countries. Given that the critical timing for such actions is within 12 months from the date of application, we ensure clients are informed and ready to make decisions well within 6-8 months from the date of application, guiding them through every step.

4. For PCT filings, after receiving the international search report, we delve deeply into strategic analysis, advising on key decisions like choosing countries for entry and initiating further examinations, tailored specifically to enhance our clients' global IP position.

Considering the statutory timeframe for a PCT application to enter various countries is within 30 months from the priority date (aligned with the domestic application date), Junzhiquan advises clients at an opportune moment (no later than 24 months from the priority date) on country selection for entry and commences preparatory actions accordingly.

II. Unique Features of Junzhiquan's Patent Mining and Filing Strategy

Drawing on our extensive experience and thoughtful consideration, Junzhiquan employs a unique “R&D-led” strategy in its patent mining and filing efforts. By fostering deep communication with the R&D team, we meticulously uncover every valuable technical aspect within a project and conduct thorough and detailed searches for each. Drawing on our rich experience from extensive patent litigation, we craft a strategic plan for each technical detail, ensuring the patents are robust and enforceable.

Junzhiquan’s Approach to Unearthing Valuable Technical Insights:

1. We encourage R&D personnel to spotlight the innovative moments in their research and development process.

2. Starting from these innovative insights, we expand our planning to encompass these key innovations fully.

3. With acute professional insight, we sift through less obvious technologies, identifying those that offer improvements over existing ones.

4. We tailor our approach based on the project's needs, suggesting alternative or less optimal but valuable strategies. These strategies are crucial for a comprehensive patent application.

This deep and strategic exploration ensures that no innovation is missed and the scope of protection is not compromised, all while avoiding non-inventive filings. By creating a full-fledged rights system, Junzhiquan not only overcomes the challenge of ensuring that superior technology is adequately protected by robust patents but also significantly boosts the chances of patent approval, offering maximal protection for original innovations.

This meticulous process ensures the originality of each patent application, greatly enhancing approval odds.

Additionally, by strategically organizing different technical points and adopting a dual strategy that distinguishes between inventions and utility models, we construct a multidimensional patent landscape for each product. This method results in a significant patent portfolio, providing ample options for future use. It places patent owners in a strong position for enforcement, business negotiations, and licensing, effectively warding off potential infringers.
