A series of cases of Junzhiquan as the agent for Huawei to sue Samsung for infringement of SEP and NSEP
In 2019, Huawei and Samsung reached a comprehensive settlement after nearly three years of dispute over the standard essential patent (SEP) and non-standard essential patent (NSEP). Among them, Guangdong Junzhiquan Law Firm (Junzhiquan) acted as an agent in successfully concluding six SEP cases accepted by the Shenzhen Intermediate People’s Court.
Upon receiving the client’s commission, Junzhiquan promptly organized a team of senior professionals in the relevant field, including experienced lawyers and patent agents. Confronted with intricate cases, challenging legal issues, and technical hurdles, the Junzhiquan team collaborated closely with the Huawei team, communicated extensively, untangled complexities, and identified key aspects, together achieving numerous crucial victories:
1. At the Patent Reexamination Board, all six SEP cases represented by Junzhiquan were upheld as valid.
2. At the Shenzhen Intermediate People’s Court, Junzhiquan represented Huawei and won the first case ((2016) Y03MC No. 840) of SEP infringement against Samsung (the other five cases did not go to trial). Samsung was ordered to cease immediately the infringement of Huawei’s patent right (ZL 201010137731.2) through manufacturing, selling, promising to sell, or using. The court upheld Huawei’s litigation requests in this case.
The crucial victory mentioned above bolstered Huawei’s position in the negotiation process for the entire series of cases and made a significant contribution to the ultimate success of these cases.
