A case of Junzhiquan acting as the agent for International Yineng Co., Ltd. to sue Universal Music Group for trademark invalidation
The trademark for International Yineng was applied for registration on November 6, 2015, and was approved on December 14, 2016. International Yineng legally holds the trademark rights.
Universal Music claimed that the logo “J5” is utilized by its famed pop band “The Jackson 5” featuring music icons Michael Jackson, Jackie Jackson, Tito Jackson, Jermaine Jackson, and Marlon Jackson, thus arguing that International Yineng’s “J5” trademark infringed upon its existing copyright for the “J5” pattern, the name rights and prior commercialization rights related to its artist band Jackson 5. Therefore, the trademark was requested to be declared invalid.
Upon being entrusted with the case, Junzhiquan quickly mobilized a team, which effectively persuaded the Trademark Review and Adjudication Board to dismiss Universal Music’s invalidation request, countering allegations of “J5” infringement on Universal Music’s existing copyright for the “J5” pattern, the name rights and prior commercialization rights related to its artist band Jackson 5. Junzhiquan team’s precise and vigorous defense led to the 2019 verdict from the Trademark Review and Adjudication Board upholding the validity of the “J5” trademark.
